Rappel des faits :
Le 27 Décembre 2011, après avoir pris un verre à la foire de Kumba, Gideon 23 ans, Leonard 24 ans, Kelvin 30 ans et Raphael 22 ans tous étudiants, rentrent chez un de leur amis pour y passer la nuit. Arrivés dans le quartier où vit leur ami, les 4 jeunes hommes sont interpellés par un jeune homme qui a l’habitude de leur demander de l’argent, mais cette nuit aucun des 4 ne lui donnera ce qu’il demande. Plus tard dans la nuit pendant que nos amis dormaient, le jeune homme s’est mis à hurler, à appeler le voisinage, les alertant contre les homosexuels qui étaient en pleins ébats dans la pièce où nos 4 amis étaient couchés. La population accourue aussitôt, il s’ensuivit une violente bastonnade pour Gideon, Leonard, Kelvin et Raphael.
Après la bastonnade les 4 infortunés ont regagné chacun sa famille, mais contre toute attente le beau-frère de Raphael 22 ans le conduit au commissariat où il le dénonce, le présentant comme un gay. L’infortuné sera sévèrement battu par les policiers jusqu’à ce qu’il avoue que Kelvin 30 ans est son amant. Immédiatement après cet aveu, une descente est faite dans les domiciles de kelvin, Gideon et Leonard.
Ils séjourneront au commissariat de Kumba du 28 Décembre 2011 au 9 Janvier 2012, date à laquelle ils sont placés sous mandat de détention par un Procureur de la République. Ils ont également été confiés à un établissement hospitalier pour une anuscopie devant révéler qu’ils ont effectivement eu des pratiques sexuelles anales.
Le collectif d’associations suscitées va bien évidemment prendre les dispositions nécessaires pour assister tant juridiquement que matériellement les quatre mis en cause qui sont dans un état psychologique inquiétant.
Face à cette situation, le collectif
• S’insurge contre les arrestations des personnes présumées homosexuelles sur de simples dénonciations ;
• Proteste vigoureusement contre toutes formes de tortures et traitement dégradants infligés aux personnes présumées homosexuelles dans les postes de police et/ou les centres hospitaliers;
• Appelle les autorités sanitaires (Ordre des médecins) du Cameroun à systématiquement refuser de pratiquer des examens anaux dans le but de déterminer si des individus ont des pratiques sexuelles anales ;
• Appelle le gouvernement à définitivement sortir du code pénal l’article 347 bis qui condamne les relations sexuelles entre personnes de même sexe
PRESS RELEASE
The organizations ADEFHO (association for the defense of homosexuals) and SID’ADO (teenagers against the HIV/AIDS) have been informed of a new case of arrest, detention and custody of 4 men in Kumba, a town situated 3OO Km from Douala the economic capital of the country.
On December 27th 2011, after having a beer in the city trade fair, Gideon 23 years old, Leonard 24 years old, Kelvin 30 years old and Raphael 22 years old all of them students decided to spend the night in their friend’s home. While going to their friend’s home, a boy living in the neighborhood came to them and asked for money, nobody gave him the money as they use to. The same boy waited for them to be asleep and started shouting, alerting the whole neighborhood that there are gays in a house.
The four young men were awake by a hostile and angry crowd, which harshly beat them. After the beating each of the guy went back to his home, and this is when things got to worsen. Raphael’s brother in law brought him to the police station and denounced him to be a gay. Raphael was harshly beaten and tortured by the elements of the police till he accepted that he is gay; he also said Kelvin is his lover. Afterwards the police went to the homes of Kelvin, Gideon and Leonard.
They spent 11 days in detention at the police station; during their detention the 4 men were tortured. They were put in custody by the State counsel Monday January he 9th 2012 and the next day they were sent to a hospital for a anal screening with the aim of determining if they have had anal intercourse. They are currently in at the Kumba prison awaiting trial.
The collective of associations is doing its best to assist (juridical and material) the detained men.
Given this situation, the collective:
• Protests vigorously against the arrest and detention of people for alleged homosexuality based on a simple denunciation.
• Firmly protests against torture and ill treatment inflicted to alleged homosexuals in police stations and/or Hospitals
• Call the Board of Cameroonian medical doctors to clearly stand against anal screening with the purpose of determining of someone is having anal intercourse.
• Call the Cameroonian government to repeal the section 347 bis which criminalizes same sex conduct of the penal code.
